Teslar Software’s Privacy Policy

This Privacy Policy (“Policy”) describes how 3E Software, Inc. (dba Teslar Software), herein referred to as “Teslar Software”, collects and uses the personal information described in this Policy and the rights and choices individuals have regarding such information. Teslar’s policy is to keep customers’ data encrypted, safe and secure and data will not be sold to others. Our privacy policy and access to it will always be available to customers and that any time there is a policy change, customers will be notified.

Covered in this Policy

This Policy describes our privacy and data protection practices regarding personal information related to:

  • Our websites and mobile applications (“app”) that display or link to this Policy.
  • Marketing activities including any communication about Teslar Software’s events, products, and services which may be for current or prospective clients.
  • Other individuals who interact or communicate with us related to our business.

This Policy does not apply to job applicants or to our employees. It also does not apply to the personal information we process on behalf of our clients as a service provider. In addition, the policy also does not apply to information collected by Teslar offline.

The provisions of this Policy exclude and do not cover data received, used, stored, shared, or exchanged under any Teslar relationship governed by customer contracts. All terms of a customer’s contractual relationship, including data from said customers through Teslar Software’s mobile app and the customer’s data usage and storage, is exclusively governed by the relevant clauses in the parties’ agreement.  

Collection of Personal Information

What We Collect

We may collect personal information that is provided voluntarily, such as your name, email address, and phone number. Please be advised if you decline to provide certain personal information that is marked as required, you may not be able to access certain items, or we may be unable to respond to your request or inquiry.

We collect information that you provide to us, such as information shared when you schedule a Teslar demo, submit a contact form, or sign up for any of our webinars, newsletters, or events. Also collected is information gathered by automated means about you, your computer or mobile device, and your activity on the websites or mobile applications, such as operating system, device identifier, browser type, IP address, general location information, and usage information, including pages or screens accessed, length of access, and navigation paths between pages or screens.

How We Collect

When you email, call, or otherwise communicate with us, we collect and maintain a record of your contact details, communications, and our responses. We also maintain records of communications and information that you provide to us related to any customer support requests.

Teslar also collects information automatically as you navigate through the websites, including information collected through cookies, web beacons, and other tracking technologies, and from third parties, such as our business partners.

In some cases, we may use or aggregate the personal information we have about you with information obtained from other sources, such as social media platforms and public databases. Teslar Software may combine the information we collect from third party sources with the information we may collect about you directly or otherwise.

How We Use Personal Information

We collect and use personal information to respond to your inquiries, communicate with you about our business, products, or use of our website and app, and for client support and research. The information we collect helps us to estimate our audience size and usage patterns, store information about your preferences which allows us to customize the Websites according to your individual interests, speed up your searches, and recognize you when you return to the Websites. 

You may unsubscribe from our marketing communications at any time by following the instructions included in the bottom of those emails.

Disclosure of Information

We may disclose anonymous or non-identifiable data for the purposes described above to third party platforms and providers we use to provide certain features or portions of our websites and mobile apps, or for analytics, research, or other purposes.

Teslar Software does not sell or share identifiable personal user data procured from their website or mobile app with third parties.

It is possible that we disclose information about you when required by law, subpoena, or other legal process. It is also possible disclosure will be necessary if such disclosure is believed necessary to protect the security or integrity of our business or to protect our employees or clients.

Third Party Sites and Links

Our websites and apps may contain links to third-party services. We do not own, operate, or control the websites of third parties. This Policy does not apply to any services maintained or operated by third parties. When you click on those links, you will go to a third-party website where you will be subject to that service’s privacy policy or similar statement and terms of use. We are not responsible for the privacy practices of other websites or services. If you have any questions about the third party’s targeted content, you should contact them directly.

Cookies and Analytics

Our websites and apps may use first party and third-party cookies, pixel tags, plugins, and other tools to gather device, usage and browsing information when users access our websites or mobile apps.

This information is used to analyze and improve our website and app experience and functionality, to measure advertising campaigns, improve our advertising and content offerings, and for security purposes.

Minors

Teslar Software’s websites, apps, and products are not intended for or directed at minors, and we do not knowingly collect any personal information from children under age 18. If we discover that a child has provided us with personal information, it will be promptly deleted.

Security

We take many precautions to protect your personal information. However, please be aware that we cannot guarantee our security measures will prevent every unauthorized access attempt or misuse. Any transmission of personal information to the websites is provided at your own risk. We are not responsible for circumvention of any privacy and security measures.  You are also responsible for data security. If you have log in credentials to access certain parts of the websites, you are responsible for keeping those credentials confidential. You are responsible for the security of your devices and internet connections.

California Privacy Notice

This California Privacy Notice applies only to residents of the State of California utilizing Teslar Software’s website, and only where we act as a “business” with or for that individual. This section is a supplement to the other parts of our policies. However, this section does not apply when we provide our Services to customers through our mobile app which is governed by separate contractual agreements.

This California Privacy Notice describes how Teslar Software as a business collects, uses, discloses, and otherwise processes personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 (“CCPA”).

The categories of personal information that we collect and the sources from which we collect that information are:

  • Identifiers (for example: name, address, phone number, email address, and other similar identifiers) – from you;
  • Internet or other electronic network activity information (for example: IP address, browser and device data, browsing history, search history, analytics information) – from your device or browser;
  • Geolocation information (for example: location data from device or IP address) – from your device or browser; and
  • Inferences (information that could be used to create a user profile reflecting your preferences, attitudes, behavior, and similar characteristics) – from you.

Teslar Software does not sell or share identifiable personal user data procured from their website or mobile app with third parties.

If you are a qualifying California resident under CCPA, we provide the following rights with respect to your personal information when we act as a “business” with or for you (subject to certain limitations in the CCPA):

  • Right to Know About Personal Information Collected, Shared, Sold or Disclosed. When we collect personal information, you have the right to know the categories of personal information collected and the categories of sources from which it was obtained, the purposes for which personal information was collected, sold or shared, the categories of third parties to whom we disclosed personal information, the specific pieces of personal information we have collected about you and the categories of personal information that were shared or sold.
  • Right to Request Deletion of Personal Information. You have the right to request that we delete your personal information unless we need to keep the information as permitted by the CCPA.
  • Right to Request Correction of Inaccurate Personal Information. You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Opt-Out of the Selling or Sharing of Personal Information. You have the right to opt-out of the selling or sharing of personal information.
  • Right to Limit the Use or Disclosure of Sensitive Personal Information. You have the right to limit our use of or sharing of sensitive personal information.
  • Right to Non-Discrimination and No Retaliation. We will not discriminate against you for exercising your CCPA rights. If you are an employee, applicant for employment or independent contractor, we also will not retaliate against you for exercising your CCPA rights.

We will need to verify your identity before processing CCPA and other California requests, which may require us to request and obtain additional information from you. We will use that information only to review and address your requests. We reserve the right to decline or limit requests in certain circumstances – for example, when we are unable to verify your identity or locate information in our systems, or when you have previously made two CCPA requests in the prior 12 months, or as otherwise permitted by applicable law. You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your CCPA and other California rights. Before accepting such a request from an agent, we will require the agent to provide us with proof that you have authorized it to act on your behalf, and we may also need you to verify your identity directly with us.
